Construction defects can occur just as easily in condominiums as they can in houses. Just as the owners of houses have the right to take action, so too do the owners of condos. When a condo owner discovers a leak, water damage, mold damage or any other construction defect, he or she can seek compensation for damages through legal action.
However, there are definitely major differences in how these cases unfold.
One of the unique aspects of these cases is that if there is a defect in one unit, there might be a defect in more units. In fact, because developers and construction companies often work on many condominium developments, the defect may even run through multiple developments.
Upon discovering a defect, a condo owner may want to communicate with the condo association as soon as possible to determine the full extent of the problem, and the association may need to determine what steps to take to resolve the issue.
Condo owners have the right to expect that their home be defect free and that discovered defects be repaired as soon as possible. Condo associations have rights and responsibilities as well, and one of those responsibilities may be to see that the damage is repaired to ensure a livable environment and to prevent further damage. The money spent on the repairs may be recovered in a construction defect lawsuit.
Whether you are a condo owner or a representative of the condominium association, you may want to discuss the matter with an experienced lawyer as soon as possible to learn about your rights, responsibilities and options for moving forward.
At Heekin Law, P.A., we have decades of experience representing condo owners and condo associations in construction defect claims. From determining who is responsible for the defect to offering guidance on repairs to taking action to pursue compensation for damages, we are comprehensive in our approach to these complex cases.
PS. We requested gutter guards to protect us from leaves……so…… they only applied the gutters to half of the condo gutters leaving the front gutter open to leaves. I was told that I could have the other half done at my expense. I have never been treated like this.
In my professional career if I only did half of what was required , people would die. I have high standards and living like this is not acceptable.

We are dealing with Bielinsk Home Management. They lie, they convolute the problem and have difficulty with the truth. They don’t follow through with anything. They don’t return your phone calls. I have asked to speak with Mr. Bielinski and was told he doesn’t speak to the home/condo owners.
We have taken our life savings and invested in his condos. It would be so much easier if he would accept the defective workmanship and get things done. We had 1 year warranty on the condo. The defect was noted and documented. They would respond with a temporary fix. The identical problem would return and we would be told that the warranty was past. We are not new young homeowners. We had homes which we maintained and have a strong knowledge base of home maintenance.
I had Mexican speaking men who opened a locked door and stepped into my condo. My dog was right on task and they left laughing. I spoke to Tracy and she told me that in there Mexican culture they freely walk in and out of homes. I told her we live in America and not Mexico. I reported this to our Police. After being gone I would come home and smell a scent of a strong old aftershave. Things were taken from my refrigerator. I called Belinski and told them that these unwanted people had a key. They were coming into my condo and scared my poor dog. She was shaking and whimpering. She was under the bed. I had never seen her like this. The very first night I saw fleas in the master bath. My dog was staying with friends for a few days. I sprayed the bathroom and master bedroom and they keep returning. I asked for a professional pest removal but they said that they didn’t see a problem. I had the project manager in the condo and showed him the fleas.
This is my first new home and I was looking forward to not having to worry about other people infestations. The new appliances have had problems and needed repair. I thought I wouldn’t have to worry about repairs but that is not the case. I went to the appliance store and asked to see the receipt for my condo appliances and they didn’t answer me.
